Terms of Service

These Terms of Service ("Terms") govern access to and use of Outbid.top (the "Service"), including its public leaderboard, listings, checkout, and related features. By using the Service, submitting a listing, or completing a payment, you agree to these Terms and our Privacy Policy.
Operator and contact
The Service is operated as Outbid.top and is provided from https://outbid.top. Legal, listing, privacy, and customer-support notices may be sent to support@outbid.top.
These Terms work together with the public Rules. If the Rules and these Terms conflict, these Terms control.
What the Service is
Outbid.top is a paid public leaderboard. You may pay to list a product website, public project, or X profile and occupy a rank based on the total amount paid, as described in the Rules. Listings are paid placements, not editorial reviews, certifications, endorsements, or independent rankings.
A payment buys ranking placement at the position that the paid total supports when payment is confirmed. It does not buy traffic, clicks, customers, revenue, exclusive placement, a fixed duration at a particular rank, search-engine ranking, or any other result. Another listing may later pay more and outrank you.
Eligibility
- You must be at least 18 years old and legally able to enter a binding contract.
- If you use the Service for a company or other organization, you represent that you have authority to bind it, and "you" includes that organization.
- You may not use the Service if applicable law or trade sanctions prohibit you from receiving the Service.
Payments, Creem, and taxes
Checkout is processed by Creem. We do not collect or store full payment-card numbers. Creem's terms and privacy notice also apply to payment processing. Bid amounts are priced in US dollars, and applicable taxes may be added or handled at checkout.
Bid minimums, ranking rules, and the amount due are described in the Rules and shown before payment. Rank is assigned only after payment is confirmed and the listing is published or upgraded at the position its new total then supports.
Refunds
Completed payments are final and non-refundable except where mandatory law requires otherwise. Ranking placement is a digital service that begins when payment is confirmed: a listing is published or upgraded and the paid amount is counted on the public board.
Being outranked, receiving fewer clicks than expected, temporary downtime, or later removal for violating these Terms does not create a right to a refund. By completing checkout, you request immediate performance of the digital service and acknowledge that any withdrawal or cooling-off right is waived to the extent applicable law permits. We honor consumer rights that cannot legally be waived.
Listings and your warranties
You may submit only a website, project, or X profile that you own or are authorized to represent. The destination must show accurate and legally required operator, contact, business-register, tax, privacy, and other notices where applicable.
By submitting a destination or payment, you represent that you have the right to list it, the information is accurate, and the listing and destination comply with applicable advertising, consumer, privacy, intellectual-property, and regulated-industry laws. You must not impersonate another person or list a competitor without authorization.
Prohibited listings and use
- Scams, phishing, malware, fake login pages, suspicious downloads, or destinations primarily intended to deceive.
- Adult content, gambling, illegal drugs, hate, harassment, violence, impersonation, or exploitation of children.
- Counterfeit goods, unauthorized streaming, infringement, or regulated offers for which you lack required licenses.
- Chat, invitation, closed-group, or link-shortener destinations that do not identify a real public product or profile.
- Manipulating click counts, bypassing rate limits, disrupting the Service, unauthorized automated bidding, or scraping to build a competing ranking service.
Moderation and removal
We may refuse, delay, edit, recategorize, hide, or permanently remove a listing or bid, with or without notice, if we reasonably believe the Terms, Rules, payment-provider requirements, third-party rights, or law may have been violated, or if the listing creates legal, security, or reputational risk. Removal for these reasons does not entitle you to a refund.
Listing metadata and license
To operate the board, we may fetch and display public information about a submitted destination, including its name, handle, title, description, logo, favicon, Open Graph image, and profile image. Third-party names and marks are used only to identify where a paid listing leads and do not imply endorsement.
You grant us a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, resize, format, and publicly display the submitted listing and its public metadata for as long as reasonably needed to operate, promote, moderate, and maintain the Service and its records.
Complaints and rights notices
To report an unlawful listing or a copyright, trademark, privacy, publicity, or other rights issue, email support@outbid.top with your contact details, the Outbid.top listing, the destination, a description of the issue, and confirmation that your notice is accurate and you are authorized to submit it. We may restrict the listing during review and may share the notice with the lister where appropriate.
No endorsement and third-party sites
Appearance on the board is not our opinion of a product. We do not verify every listed company, claim, price, or result. Click counts describe what our systems recorded and do not promise the same outcome for any user.
Links to listed websites or X profiles leave the Service. Those destinations have their own terms and privacy practices, and we are not responsible for their content, security, or availability.
Availability and changes
The Service is provided as-is and may be unavailable, delayed, or incorrect. We may change, pause, or discontinue features, ranking rules, minimums, or these Terms. A material Terms update will change the date at the top of this page. Terms in effect at checkout continue to govern a completed payment unless a change is required by law or needed to address a legal or security risk.
Disclaimers and liability
To the fullest extent permitted by law, we disclaim express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that listings, ranks, metadata, or click counts will always be accurate.
We do not exclude liability that applicable law does not allow us to exclude. Otherwise, we are not liable for lost profits, data, goodwill, substitute services, or indirect, incidental, special, or consequential damages. Our total liability for a claim relating to a payment will not exceed the amount paid for the listing concerned during the three months before the claim.
Indemnity and general terms
You will defend and indemnify Outbid.top and people working on the Service against claims, damages, losses, and reasonable legal costs arising from your listing, destination, payment dispute, breach of these Terms, or infringement of another person's rights, to the extent applicable law permits.
These Terms are governed by the law applicable to the Service operator, without limiting mandatory consumer protections that apply where you live. If any provision is unenforceable, the rest remains effective. These Terms, the Rules, the Privacy Policy, and checkout details form the entire agreement for the Service.
